Update: Jamie Foxx Won't Face Charges for Alleged 2002 Penis Slapping Incident


Update: According to TMZ, the case made against Foxx for allegedly slapping a woman with his penis in 2002 has been closed. The Las Vegas Police Department said Jamie Foxx is not in any trouble because criminally, the statute of limitations on the case is up. The statute of limitations was three years. Along with that, the statute of limitations on filing a civil suit has ran out as well.

Jamie Foxx is being accused of sexually assaulting a woman 16 years ago in Las Vegas. According to TMZ, the woman claims that she and a friend were at Foxx's place when he attempted to get her to perform oral sex. After she denied to go down on Foxx, she claims he slapped her in the face with his penis.
After the alleged assault, the victim says a member of Foxx's entourage kicked her out the place. She also claims she went to the hospital the next day when she returned to Los Angeles after suffering a severe panic attack.
Foxx's attorney, Allison Hart of Lavely & Singer, told TMZ the entire story is made up. "Jamie emphatically denies that this incident ever occurred, and he will be filing a report with the Las Vegas Police Department against the woman for filing a false police report against him," he stated.
"The first time [Jamie] became aware of this woman's absurd claims about an incident that supposedly occurred 16 years ago was when TMZ contacted his representatives [Tuesday] about this story." The statue of limitations in Nevada sits at three years, so although the case is "open," it is technically outside of prosecutable limits.
