RadioOnFire.com - Both the prosecution and the defense in Jelani Maraj's rape case have agreed to postpone the trial a couple of months.
The trial was set to begin earlier this week, but prosecutors petitioned for proceedings to be pushed back from the scheduled May 8 date so that they may have more time to prepare Maraj's arguments. The Nassau County Court overseeing the first day of jury selection on Monday agreed to grant the request, thus setting a date for them to re-commence in the late Summer, early Fall, with Maraj's next court appearance marked down for July.
Maraj is facing 15 years to life in prison on charges of first-degree rape and first-degree sexual conduct against a child, for allegedly raping and sodomizing a 12-year-old girl over the course of several months in 2015. He has pleaded not guilty, with his defense exuding confidence that he can fight the accusations. Maraj's lawyer has filed several motions, including one requesting that certain evidence presented by the prosecution be dismissed and another insisting that evidence they've presented be introduced, to allegedly show that a damning particle of DNA found on the accuser's clothes suddenly appeared nine months after she filed her claims.
Maraj's team is building their argument around the notion that he is being set up, adding that none of the hair fibers recovered from her clothes are linked to Maraj and that there was never any DNA found on his underwear, despite the victim claiming she was on her period during an instance in which she was raped.
