RadioOnFire.com - Previously this year, the Trump administration tried to set a ban on transgender people from joining the military. However, it was not put in place after a lawsuit arose that opposed the ban. Soldiers filed a lawsuit against the administration, saying that the ban cut into their career opportunities, as well as medical treatments despite the policy not even being in place as of yet. Trump took to Twitter to announce the transgender military ban, which created much confusion for the military. According to reports, the administration did not have any policy ready to back up the claim Trump was making via Twitter.
Now, the administration is reportedly asking that a federal court not consider the lawsuit that goes against the transgender military ban. Justice Department lawyers wrote a brief saying the legal challenge is “premature several times over.” The brief went on to say “Plaintiffs’ claims are not ripe, as the issues presented are not fit for judicial decision, no actual discharge or denial of accession has occurred, and they will not suffer a hardship if the Court withholds consideration until after the policies challenged in this case are implemented and are found to impact Plaintiffs.”
The Justice Department pointed out that since the Secretary of Defense is still temporarily allowing transgender troops to serve in the military, the lawsuit has no type of case to make. If the ban were to go into effect, it would possibly happen in March 2018.
