NJ Dealer Caught with $25K in Heroin Gets 6 Months of Rehab, No Prison


RadioOnFire.com - Thanks to a prison reform policy in New Jersey, a repeat drug dealing offender, who was busted with $25,000 worth of heroin back in May of last year, was sentenced to six months of rehab and five years probation on Wednesday [Feb. 1].
When Gary Fox, 30, was arrested by Toms River police nearly nine months ago, he was slapped with possession of heroin, possession of heroin with intent to distribute, possession of over 50 grams of marijuana, and possession of marijuana with intent to distribute among other charges. The officers who raided his home had found 80 wax folds of the drug before their search led them to his a storage unit where he had been keeping 83 heroin bricks, amounting to 4,150 doses. He would be caught with more drugs in June when 40 wax folds of heroin and more than 1.5 pounds of marijuana found in his home.
Before pleading guilty to two counts of third-degree possession with intent to distribute and a count of possession, Fox had agreed to undergo rehab between the months of November and January, after being found eligible to have his sentence dramatically shortened under the state's Drug Court program. Jersey Governor, Chris Christie, implemented the reform effort in his state after deciding to approach drug addiction in parts as a sickness. Under the program, the law pursues justice with a preference towards rehabilitation over imprisonment.
Fox now faces an alternate prison sentence of 10 years in prison with 3 1/2 years of parole ineligibility if he fails to complete the Drug Court program, according to a spokesman for the Ocean County Prosecutor’s Office, who added Wednesday that the sentence was not a result of a plea deal with prosecutors. It appears as though Fox isn't only a dealer, but a user, and was thus able to pass screening for the Drug Court. Fox has a record of drug dealing and using, having been sent to rehab after a 2009 conviction for possession of cocaine and Percocet.
